Find Out What Has Actually Happened
Ask for copies of any proposed agreement, offer, or court papers. Keep the envelope and note when papers were delivered. A conversation about selling is different from a filed partition case.
If you have been served with court papers or received a deadline, contact a local attorney promptly. Do not wait for a research report before responding to the legal matter.
What a Partition Case Means
A co-owner may ask a court to divide jointly owned property or order a sale. State law and the particular facts determine the procedure and protections.
The Uniform Partition of Heirs Property Act provides protections for qualifying property in states that have adopted it. A lawyer needs to determine whether the law applies to your case and explain the relevant deadlines.
Organize What Your Lawyer Will Need
Gather the deed, family relationships, prior estate records, tax notices, and correspondence about the sale. Write down who lives on or uses the property and what outcome you want.
Heir research can support the ownership history. It cannot stop a sale, answer a lawsuit, or provide legal representation.
